FIRST ON DAILY SIGNAL—Federal agencies are continuing to defend some legal positions of the Biden administration, according to an analysis by two conservative groups.

Leaders of the groups Power the Future and Defend Forgotten America sent a letter Tuesday to President Donald Trump and Attorney General Todd Blanche calling for a comprehensive review of lawsuits involving regulations and legal positions adopted or defended by the Obama and Biden administrations.

The letter highlights several lawsuits involving energy, environmental, and health care regulation.

“Inconsistent execution of your presidential authority must cease,” says the letter to Trump, signed by Daniel Turner, executive director of Power the Future; Jenn Pellegrino, CEO of Defend Forgotten America, or DFA; and Ali Bartlett, the DFA counsel.

“Some agencies have yet to fully align their litigation positions expressly with the Administration’s announced policy. Others continue to defend inherited positions that warrant review under your directives,” the letter states.

Among the biggest cases mentioned pertains to the Obama administration’s Clean Power Plan, designed to spur a massive shift of energy production from coal and gas to wind and solar. The Supreme Court found that the Environmental Protection Agency lacked the authority to implement the sweeping plan in the case of West Virginia v. EPA.

Following the ruling, the agency finalized a partial repeal of the regulations in September, set to take effect in November, but “leaves some requirements in place, which EPA proposes to rescind separately,” the letter says.

“EPA and DOJ should explain what issues remain for judicial resolution and seek the appropriate disposition,” the letter says.

The letter also references the ongoing case of Texas v. Oz, where the Centers for Medicare and Medicaid Services is defending a Biden-era policy that threatens funding mechanisms for rural and some urban hospitals. The agency’s interpretation could jeopardize billions of dollars in Medicaid funding, the letter says, adding that the agency demanded compliance in a Florida case after a federal judge had issued an injunction in the same matter in Texas.

“Rather than reconsider its interpretation after the district court rejected it, CMS treated the injunction’s geographic limitation to Texas as an opening to press the same policy in other States,” the letter states.

The groups want the Justice Department and the Department of Health and Human Services to “acknowledge these errors, abandon the challenged interpretation, and vacate the agency actions implementing it.”

“The American people elected this administration in substantial part because it promised to end that overreach, especially in environmental, energy, and health-care policy,” the letter says.

“Executive Order No. 14,215, ‘Ensuring Accountability for All Agencies,’ prohibits executive branch employees from advancing a legal interpretation as the position of the United States when it conflicts with the President’s or Attorney General’s opinion,” the letter says.

The letter also discusses Chamber of Commerce v. EPA, in which the D.C. Circuit on Aug. 18 upheld the EPA’s designation of PFOA, or perfluorooctanoic acid, and PFOS, or perfluorooctanesulfonic acid, as hazardous substances under federal Superfund law. The letter acknowledges that the Trump EPA chose to retain the designation but asks the administration to explain how that decision fits its broader regulatory approach.

In a separate case, American Water Works Association v. EPA, the D.C. Circuit heard arguments Sept. 18 over federal drinking-water standards for PFAS chemicals. The letter says EPA is defending limits for PFOA and PFOS while proposing to rescind limits for four other PFAS categories. The proposed rescission had not been finalized when the letter was written.

Neither the White House nor the Justice Department responded to inquiries for this story by publication time.

Ohio received a shoutout from the federal government on Friday in Columbus as Treasury Secretary Scott Bessent appeared with Sen. Jon Husted to give remarks promoting the Education Freedom Tax Credit.

The tax credit, also known as the Federal Scholarship Tax Credit, was a provision of the Working Families Tax Cuts, with Husted playing a major role.

Earlier this month, the Trump administration announced proposed regulations for the tax credit, which will be available on Jan. 1, 2027.

The tax credits have not only been promoted and celebrated by the Trump administration but also by the Columbus-based Center for Christian Virtue, for whom school choice is a priority, especially through its Ohio Christian Education Network.

The roundtable was attended by Troy McIntosh, director of the education network, who spoke to the Daily Signal, saying his group was “pleased” to share with the secretary and senator how programs like the tax cuts “provide families with a life-altering educational option for their children.”

“By almost any measure, we are experiencing an educational crisis in our country,” McIntosh said. “Yet innovative programs like the FSTC that empower parents to make decisions for their children, and to escape a broken and philosophically damaged government school system, are vital to restoring our country to its place as a world leader in K-12 education.

“The fact is, according to the nation’s report card, two-thirds of Ohio’s public school eighth graders are not proficient in reading and three-fourths of them are not proficient in math. Without the lifeline that school choice programs and the FSTC provide, hundreds of thousands of children will be left in the system that produced these results.”

McIntosh added that his group looks forward to providing families better options “through the Christian Education Network SGO.”

Husted was Ohio speaker when the Legislature created the EdChoice scholarship, which is being litigated and is expected to ultimately end up at the Ohio Supreme Court. According to Husted, 150,000 students have made use of the program.

When speaking with WSYX ABC 6 following the roundtable, Husted did not mince words as he described the appellate court ruling as “terrible” and noted “it will be appealed and it will fail” and that “school choice will be preserved.” The program is allowed to continue while the state appeals.

Husted noted how school choice programs have been upheld before, further speaking to particular details of the litigation this time around.

“They’ve been forum shopping to find a judge or a couple judges that will strike it down. This will ultimately be upheld because this country was based on freedom,” the senator said. “This country values education and in the end families in Ohio will demand that they have access to being able to send their child to a school of their choice.”

Bessent promoted the human side of the event, as he said that the best part of his job “is visiting communities like this one to see how the president’s policies are reaching the American people,” which he framed as “policies to people.” Bessent also praised Husted for his leadership on the Working Families Tax Cuts, noting that “none of the progress that we’re here to discuss today would have been possible without him.”

The secretary also promoted the tax credits and school choice as being able to “access to a quality education and the chance to achieve the American dream.”

“The Education Freedom Tax Credit will allow Americans to contribute to any scholarship granting organization of their choice and then reduce their federal tax bill dollar for dollar by up to $1,700,” Bessent explained.

Families can choose faith-based private schools, like the Crown Preparatory Academy where the event was held, or use the funds for services for those families remaining in public schools.

Bessent also later spoke to the importance of parents who want to “tailor their children’s learning experience,” making clear this program is not a voucher, as parents can keep their children in public school and make use of supplemental education.

“Different kinds of students require different kinds of support, and the great virtue of this program is that it will lower costs for parents and families however they seek to use a scholarship all without diverting a dime from local public schools. Here in Ohio, Sen. Husted championed a scholarship that has helped over 100,000 families find the right education for their children,” Bessent explained.

The secretary explained that, among all 50 states, 30 states currently have opted in to the program. He encouraged the remaining states to participate “so that every student is eligible for a life-changing scholarship.”

“Under President [Donald] Trump’s leadership, we are working to place the full range of a family’s educational needs within reach and to give every American child the chance to flourish,” Bessent said.

The Women’s National Basketball Association declared two former male professional basketball players ineligible to join the league because they aren’t women. However, the league did not provide a definition of “woman” in its announcement. 

While responding to an inquiry from several members of Congress about player safety and the league’s definition of a woman, WNBA Commissioner Cathy Engelbert stated in an Oct. 16 letter, “Only women are eligible to play in the WNBA and the individuals you cite in your letter are both men.” The dispute stems from August, when former National Basketball Association players Enes Kanter Freedom and Royce White said they identified as women and were thus eligible to enter the WNBA’s 2027 Draft.  

Announcing Engelbert’s decision on X, Kanter Freedom said in a Tuesday post, “Apparently, the WNBA still can’t define what a WOMAN is, but they’re absolutely certain they know what a MAN is! How convenient!” 

“WNBA Commissioner Cathy Engelbert has declared that I am a man,” he added. “Who gave her the authority to decide who I am? Who gets to define my identity? And how can the WNBA determine who is a man without explaining what qualifies someone as a woman.” 

The league’s collective bargaining agreement states that “only women are eligible to play in the WNBA.” Kanter Freedom and others have used this verbiage to highlight the league’s lack of clarity and narrow player eligibility to biological women. 

Over the summer, multiple WNBA players, coaches, and associations addressed the possibility of trans-identifying athletes entering women’s basketball.  

Kanter Freedom pointed to WNBA player Gabriella Williams’ statement that she “would welcome any trans athlete on my team or against my team anytime” as motivation for his actions.  

In an August post announcing his intent to enter the league, he wrote on X, “If simply declaring who you are is all that’s required, then I meet every single requirement necessary to compete in the WNBA.” 

Shortly after, the WNBA players’ association released a statement on social media condemning the stunt.  

“We embrace justice equity, diversity, and inclusion,” the statement read. “Those are the values that unite this Union and allow it to protect women’s sports while creating transformational change. Hate, abuse, and demonization of any person or group of people, including transgender people, only fuel fear, division, and harm. We will continue to have hard conversations. But we will not be used as political pawns.” 

Rep. Marlin Stutzman, one of the lawmakers who wrote the September letter, told OutKick that the WNBA’s denial of eligibility was “the first step in defining what a woman is for the sports community.” 

“By clearly labeling Enes Kanter Freedom and Royce White as men,” he continued, “they have acknowledged that identifying as a woman does not change basic human biology.”
